Terms of Service

Welcome to Hands of Hope foundation ("we," "us," "our," or the "Foundation"). These Terms of Service (the "Terms") govern your access to and use of our website, including any donation, fundraising, or related services offered through it (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
1. About us
Hands of Hope foundation is a non-profit organization recognized as tax-exempt under Section 501(c)(3) of the U.S. Internal Revenue Code, EIN 41-4980688. Our principal place of business is 2935 Adams St NE, Albuquerque, NM 87110, United States. Contributions to Hands of Hope foundation are tax-deductible to the extent allowed by U.S. federal law.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.
3. Donations
3.1 Authorization
When you make a donation through the Services, you authorize us (and our payment processors) to charge the payment method you provide for the amount of your donation plus any optional tip you have selected. Donations are processed through PCI-compliant third-party payment processors; we never store full card numbers on our systems.
3.2 Final and one-time by default
Unless you have explicitly enrolled in a recurring donation program, all donations are one-time and final once processed. Refund eligibility is governed by our Refund Policy.
3.3 Use of funds
Donations are made to the Foundation and are used to advance its charitable mission. While we aim to direct funds to the campaign you select, all contributions are owned by the Foundation and the Board of Directors retains ultimate discretion to redirect funds when a campaign becomes over-funded, unfeasible, or otherwise inconsistent with our mission, in accordance with IRS variance-power principles.
3.4 Tip to Hands of Hope foundation
Donors may optionally add a tip on top of their donation. Tips support the Foundation's general operating costs (payment processing, compliance, technology, and support).
3.5 Tax receipts
For U.S. donors making a tax-deductible donation, an electronic receipt is issued by email at the time of the donation. For year-end consolidated statements or replacement receipts, please open a ticket via our support form.
4. Acceptable use
You agree NOT to use the Services to:
- Engage in fraud, money laundering, sanctions-evasion, or any activity that violates applicable law;
- Impersonate another person or misrepresent your affiliation with any person or organization;
- Submit content that is unlawful, abusive, harassing, defamatory, obscene, or that infringes the rights of others;
- Attempt to circumvent security measures, scrape data at scale, or interfere with the technical operation of the Services;
- Use the Services to solicit donations on behalf of a person or cause without our written permission.
5. Account security
If you create an account or are provided one, you are responsible for all activity that occurs under your credentials. Notify us immediately at adm@handsunitedforsolidarity.org if you suspect unauthorized access.
6. Intellectual property
All content on the Services, including text, graphics, logos, the "Hands of Hope" mark, photos, video, and software, is owned by the Foundation or its licensors and is protected by U.S. and international copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works without our prior written consent, except as expressly permitted by these Terms.
7. User-submitted content
If you submit comments, words of support, donor names, photographs, or other content ("User Content") to the Services, you grant the Foundation a perpetual, royalty-free, worldwide, sublicensable license to use, display, reproduce, and adapt that content for the operation of the Services and the promotion of our charitable mission. You represent that you have all necessary rights to grant this license.
8. Third-party services
The Services rely on third-party payment processors, communications, and analytics providers (including but not limited to Stripe, Pagou.ai, Resend, Meta, TikTok, and Utmify). Your use of those services is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of any third party.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, secure, or error-free.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE FOUNDATION AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT YOU DONATED IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless the Foundation from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your User Content, or your misuse of the Services.
12. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law.
13. Changes to these Terms
We may update these Terms from time to time. The "Effective date" at the top of this page indicates when the current version took effect. Material changes will be communicated through the Services or by email where appropriate. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
14. Governing law and disputes
These Terms are governed by the laws of the State of New Mexico, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services shall be resolved exclusively in the state or federal courts located in Bernalillo County, New Mexico, and you consent to the personal jurisdiction of those courts.
